Once somebody passes, their assets and debts (known as their “Estate”) need to be managed and finalised by distributing it to those named in the person’s Will (known as “beneficiaries”).
Before an Estate can be distributed to the beneficiaries, the Executors need to obtain a Grant of Probate from the Probate Office of the Supreme Court of Victoria. Probate is a legal document that confirms that the deceased person’s Will is valid and provides the Executors of the Will with the legal right to manage and finalise the Estate.
If somebody dies without a valid Will, Letters of Administration are obtained from the Probate Office instead of Probate.
